Terms of Service

These Terms are a contract between you and SUB&SUB. Please read them — by signing in or sending any request through the Service, you agree to be bound by them.
1. Acceptance
By creating an account, signing in, or sending any request to api.subnsub.com, you agree to these Terms of Service (the "Terms") and to the Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.
2. About the Service
SUB&SUB ("we", "us", "the Service") operates an OpenAI-compatible API relay at https://api.subnsub.com/v1. When you send a request, we authenticate it against your account and forward it to one of several upstream AI providers (for example, OpenAI ChatGPT / Codex sessions, and similar providers we may add or remove from time to time). The Service is a relay — we do not train, modify, or generate the model output ourselves.
SUB&SUB is not affiliated with, endorsed by, or sponsored by OpenAI, Anthropic, Google, Amazon, or any other AI provider whose models may be accessible through the Service. All third-party trademarks belong to their respective owners.
3. Eligibility
- You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
- You must not be a person with whom transactions are prohibited under U.S., EU, U.K., or U.N. sanctions, export-control, or anti-terrorism laws, and you must not be located in an embargoed country or region.
- You must not be barred from receiving the Service under applicable law.
- Where required, you must comply with your local laws governing the access and use of AI-generated content.
4. Accounts & API keys
To use the Service you must create an account. You may sign in with email + password or with Google. We may send a verification email; until you verify, account features may be limited.
You agree to:
- Provide accurate registration information and keep it up to date.
- Keep your password and your API keys (
sk-cf-...) secret. Anyone holding a valid key can spend your balance. - Treat each API key as a bearer credential. If you suspect a key is leaked, revoke it immediately from the console; revocation takes effect within seconds.
- Be solely responsible for all activity that occurs under your account or through your keys, including all charges incurred.
API keys are shown to you only once at creation, in plaintext, and are stored on our side as SHA-256 hashes. We cannot recover a lost key — issue a new one and revoke the old.
5. Acceptable use
You agree not to use the Service, and not to permit anyone to use the Service through your account or keys, to:
- Violate any law, regulation, or third-party right.
- Generate, store, or distribute child sexual abuse material (CSAM); content that sexually exploits minors in any form; non-consensual intimate imagery; or content that targets a specific individual with harassment, threats, or doxxing.
- Plan, execute, or facilitate violence, terrorism, or the development of weapons (including chemical, biological, radiological, nuclear, or cyber weapons).
- Create or distribute malware, phishing kits, credential-stuffing tooling, or other content intended to compromise computer systems you do not own or have express permission to test.
- Engage in unlawful surveillance, profiling, scoring, or automated decision-making with legal or similarly significant effects on individuals, in violation of applicable law.
- Defraud, deceive, or impersonate any person or entity, or misrepresent your affiliation with any person or entity (including AI-generated impersonations).
- Evade rate limits, model whitelists, balance checks, or other technical controls; share a single account or key across an organization in a way designed to bypass per-key controls; or operate "key-rental" or "free model" reseller surfaces that obscure SUB&SUB as the underlying provider in violation of upstream policies.
- Reverse-engineer, extract, or attempt to derive training data, model weights, or the upstream model identifiers behind the relay; perform model-extraction or distillation attacks on output we deliver.
- Submit content you do not have the right to submit, or that infringes intellectual property, trade secrets, or privacy rights of others.
- Interfere with the integrity of the Service — denial of service, automated mass-registration, abuse of free-tier signup bonuses, billing manipulation, or attacks against our infrastructure or upstream providers.
We may, at our discretion, refuse, filter, or terminate requests that we reasonably believe violate this section, and we may report serious violations to the relevant upstream provider, payment processor, or law-enforcement authority.
6. Upstream provider policies
Because every request you send is forwarded to a third-party AI provider, your use is also subject to that provider's usage policies and terms. Requests routed to OpenAI ChatGPT / Codex accounts are subject to OpenAI's Usage Policies and applicable account terms. Requests routed to Anthropic Claude (via AWS CodeWhisperer / Kiro) are subject to Anthropic's Acceptable Use Policy and the AWS Service Terms. Violations of any upstream policy may cause your request to fail, your model access to be revoked, or your SUB&SUB account to be suspended.
You are responsible for ensuring that the content you submit (prompts, files, system messages) complies with both these Terms and the upstream provider's policies — including but not limited to restrictions on minors, violence, sexual content, deception, malware, and protected categories such as political persuasion at scale.
7. Fees & billing
The Service is pay-as-you-go. You prepay credits via Stripe Checkout (card, Link, Alipay, WeChat Pay, and other methods Stripe may enable from time to time) and your balance is debited per request based on the tokens consumed.

Rates depend on the model's tier — the live mapping is at docs#pricing. We bill per request, in microdollars, immediately after each request settles — for streaming requests, settlement runs once the final [DONE] chunk is delivered. Sub-cent requests are tracked accurately at micro precision.
We may change pricing or introduce per-model rates in the future. We will give you at least 14 days' notice of any price increase by publishing the new pricing on the Service and, where reasonable, by email to the address on your account. Continuing to use the Service after the effective date constitutes acceptance of the new pricing.
Credits do not expire. Negative balances are not permitted: when your balance reaches zero (or, transitionally, dips below zero on the final request), the relay returns 402 insufficient_balance until you top up.
8. Refunds
Prepaid credits are sold for immediate digital delivery and, to the maximum extent permitted by applicable law, are non-refundable once purchased. Consumed credits — i.e. amounts already debited from your balance for requests you sent — are non-refundable in all cases.
Nothing in this section limits any mandatory consumer-protection right you have under applicable law (for example, statutory cancellation periods for distance contracts in the EU/UK to the extent the digital-content waiver was not validly given, or non-waivable rights under your local consumer law). To request a refund within those rights, or to report an erroneous charge, contact [email protected] within 30 days of the charge.
If we discover that an account has been used in material violation of these Terms, we may withhold pending refunds, reverse fraudulent top-ups, and report the activity to Stripe and law enforcement.
9. Taxes
Fees are stated exclusive of taxes. You are responsible for all taxes, levies, and duties imposed by your jurisdiction on the purchase or use of the Service (other than taxes based on our net income), and you authorize us, or our payment processor, to add such taxes to your charges where we are required to collect them.
10. Availability
The Service is provided on a best-effort basis. We do not offer a service-level agreement (SLA) and do not guarantee that the Service will be available, error-free, or uninterrupted. Upstream provider outages, account-pool exhaustion, network failures, scheduled maintenance, and circumstances beyond our reasonable control may cause delays or unavailability.
11. Changes to the Service
We may add, remove, or change features, models, endpoints, parameters, rate limits, and other aspects of the Service at any time. We may discontinue the Service entirely on at least 30 days' prior notice published on the Service and, where reasonable, sent to the email address on your account, in which case we will refund any unconsumed prepaid balance via the original payment method or, where that is not practical, by an equivalent method.
12. Suspension & termination
You may close your account at any time by contacting [email protected]. We may suspend or terminate your access, revoke your API keys, and remove your account if (a) you materially breach these Terms or the Privacy Policy; (b) we are required to do so by law or by an upstream provider; (c) we reasonably believe your use poses a security, fraud, abuse, or legal risk to us, our users, or upstream providers; or (d) your account has been inactive for more than 24 months. For (a) we will, where reasonable and lawful, give you notice and an opportunity to cure; for (b) and (c) we may act without prior notice.
Sections that by their nature should survive termination — including fees owed, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
13. Intellectual property
Your content
You retain all rights in the content you submit to the Service (prompts, system messages, files) and in the outputs returned to you, to the extent any rights are held under applicable law. You are solely responsible for your content and outputs and for ensuring they may lawfully be used.
You grant SUB&SUB a non-exclusive, worldwide, royalty-free, terminable license to receive, process, and transmit your content solely to (i) operate and deliver the Service to you (including forwarding the request to an upstream provider and returning the response), (ii) bill you accurately for usage, (iii) detect and prevent abuse, and (iv) comply with law. We do not use the content of your prompts or model responses to train models and, as described in the Privacy Policy, we do not retain prompt or response bodies on our infrastructure.
The Service
The Service, the SUB&SUB name, and the SUB&SUB site design are owned by us and are protected by applicable intellectual-property laws. Nothing in these Terms transfers ownership of the Service or our trademarks to you. You may not use our marks except as needed to factually reference the Service.
If portions of our codebase are made available under an open-source license, your use of that code is governed by the license accompanying it; these Terms govern your use of the hosted Service at subnsub.com, not your use of the code itself.
14. Privacy
Our handling of personal data is described in the Privacy Policy. Please read it — it explains what we collect, what we don't, and how to exercise your data-protection rights.
15. Disclaimers
The Service and all model outputs are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, SUB&SUB disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, and quiet enjoyment, and any warranty arising from a course of dealing or usage of trade.
AI-generated outputs may be inaccurate, offensive, biased, or otherwise unsuitable. You are responsible for reviewing outputs before relying on them, and you must not rely on outputs for legal, medical, financial, safety-of-life, or other decisions where errors carry significant risk, without competent human review.
16. Limitation of liability
To the maximum extent permitted by law, in no event will SUB&SUB, its operators, contributors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to the Service, even if advised of the possibility of such damages.
Our aggregate liability for any and all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted.
17. Indemnification
You agree to defend, indemnify, and hold harmless SUB&SUB and its operators from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of (a) your content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your infringement of any third-party right. We will give you prompt notice of any such claim, reasonable cooperation in the defense at your expense, and the right to control the defense and settlement, provided that no settlement may impose any non-monetary obligation on us without our consent.
18. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The federal and state courts located in the State of Delaware will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, and you and SUB&SUB consent to that jurisdiction and venue, except that either party may seek injunctive relief in any court of competent jurisdiction.
Nothing in this section displaces non-waivable consumer-protection rights granted to you by the law of your country of residence. If you are an EU/UK consumer, you may also bring proceedings in the courts of your country of residence.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
19. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, give you reasonable advance notice — by a banner on the Service, by email, or both. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the Service before the effective date and contact us to close your account; we will refund any unconsumed prepaid balance.
